Kitchen18.com allows you to access with its content on certain terms and conditions specified below. By accessing  or subscribing to any part of our website, you are explicitly agreeing to the terms and conditions below. these terms and conditions were updated as on 23^rd June 2012, and kitchen18 reserves all rights to change, modify or alter these terms and conditions at any point of time with or without notifying existing users and subscribers.

The www.kitchen18.com is a domain owned and operated by Shubham Enterprises, a company incorporated under laws of India, with its registered office at Jayanagar 3^rd Block, #297, 10^th main, Bangalore 560 011, Karnataka(India).

This user agreement sets out the terms and conditions on which kitchen18 shall provide their services through the website for all the users. The users shall be deemed to have read, understood and accepted with our terms and conditions.

Therefore, it is clarified that use of the website by the users constitutes an acknowledgement and acceptance by users of this agreement. “Acceptance” means users affirmation in clicking on “I have read the terms and conditions and I accept them” box and on submit button as provided on the registration page. If users does not agree with any part of such terms, conditions and notices, we request the users to exit our website.       

Membership Suitability      

Use of kitchen18.com is eligible only to persons who can form legally binding contracts Act, under Indian contract Act, 1872. Persons who are unskilled to contracts within the meaning of Indian contract act, 1872 including minors, un-discharged insolvents, etc are not eligible to use the website. As a minor,  i.e. under the age of 18 years, if you wish to use or transact on kitchen18.com, such use or transaction may be made by your legal guardian or parents who have registered in our website as users. Kitchen18 reserves the right to terminate your membership and refuse to provide you with access to kitchen18 if it is brought to our notice or if it is discovered that you are a minor i.e. under the age of 18 years.

When you visit kitchen18.com, or contact us via e-mail or give your feedbacks, you are communicating with us electronically. you approve to receive communications from us electronically. We will communicate with you by posting notices on the website or by sending you emails or contacting with you via other contact information provided by you. Account and Registration Commitment

If you use our website, you shall be in charge for maintaining the confidentiality of your user ID  and password and you shall be responsible for all activities that occur under your user ID and password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete or kitchen18 has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the terms of use, Kitchen18 has the right to indefinitely suspend, terminate or block access of your membership with kitchen18 and refuse to provide you with access to the website.

Condition for warranties and limitation of Liability

All the terms are agreed to and offered by is between the user and buyer alone. The terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and after sales services related to products. Kitchen18 does not have any control, or determines, or advises or in any way involves itself in the offering or acceptance of such terms between the user and the buyer. Kitchen18 will not mediate  in any disputes between the buyer and the user.

All the services offered to through website are provide on “as is” basis without any warranty or representation of any kind from kitchen18, either experessed or implied , including without limitation any representation or warranty for accuracy, continuity, timeliness, quality, uninterrupted access, and performance for any particular purpose.

Cancellation Policy

• Buyer can cancel any order placed by him/her provided it has not been dispatched.
• Buyer cannot cancel, made to order or customized merchandise since all such items are manufactured / procured specifically against buyers order.
• Kitchen18 reserves the right to refuse or cancel any order placed  for an item/product that is listed in an incorrect place. If in case the buyer is charged, the same shall be credited to the buyers account and duly notified through e mail.
• Buyer must use their own credit card for the credit card transaction. The liability to use a card fraudulently will be on the buyer.

Refund

Once the order has been cancelled, refund will be sent to the buyer within 4 weeks. The refund will be made to the same payment options originally used to pay for the order. i.e. refund in credit card account, or net banking account or a cheque. Cheques will be sent only to the billing address of the buyer.

Applicable Law

This agreement shall be governed by and construed and interpreted in accordance with the laws of India. The place of authority shall be exclusively in Bangalore

Trademark

The logo/image of kitchen18 on the homepage of the website and other pages and as used in the communication is registered by kitchen18 and cannot be used or distributed or communicated without the specific and written permission of kitchen18.

BO Clause: "We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time"
